W numerze kwietniowym miesięcznika „Uważam Rze Historia” (nr 4/2022) zostało umieszczone na okładce zdjęcie, które redakcja kupiła od agencji East News. Autorem zdjęcia nie jest pani Daria Marchenko, ale Terrence Jennings z agencji Polaris.
Zdjęcie zostało pobrane ze strony agencji East News. Do pliku nie ma wpisanych żadnych restrykcji, ograniczeń ani specjalnych warunków cenowych (o czym świadczy dołączony poniżej zrzut obrazu strony internetowej agencji East News).
Każdego roku nasza redakcja kupuje tysiące zdjęć od różnych agencji zdjęciowych i prasowych z pełnym przekonaniem i w dobrej wierze, że agencje te mają wszelkie prawa do obrotu i sprzedaży tych dzieł.
Napis na okładce nie jest opisem zdjęcia, ale tytułem tematu numeru miesięcznika. Sprzedawca zdjęcia nie wymagał od nas umieszczenia jakiegokolwiek podpisu.
Podkreślam, że redakcja kupiła zdjęcie zgodnie z wszystkimi zasadami obowiązującymi przy tego typu transakcjach na rynku prasowym. Twierdzenie, że zdjęcie zostało „ukradzione”, jest pomówieniem w myśl art. 212 kodeksu karnego.
Nie jest w kompetencji redakcji sprawdzanie źródeł zdjęć wystawianych na sprzedaż przez agencje fotograficzne, w tym największy bank zdjęć w Polsce, jakim jest agencja East News. Podobnie nie jest w naszej kompetencji dochodzenie, czy prezydent Federacji Rosyjskiej Władimir Putin wyraził zgodę twórcom tego obrazu na sportretowanie swojego oblicza.
Redakcja kupuje materiały zdjęciowe od agencji fotograficznych, które działają jak komisy zdjęciowe.
Na marginesie należy dodać, że zdjęcie obrazu twarzy Władimira Putina było wystawione na sprzedaż przez agencję East News od dłuższego czasu. Dlaczego twórcy nie protestowali wcześniej?
Wyrażam żal, że z powodu w pełni legalnego zakupu tego zdjęcia przez redakcję miesięcznika „Uważam Rze Historia” autorka obrazu czuje się pokrzywdzona. Z całą stanowczością odrzucamy jednak wszelkie oskarżenia o próbę wyłudzenia czy kradzieży zdjęcia. Powtarzam po raz kolejny, że zdjęcie, którego autorem jest Terrence Jennings z Polaris zostało kupione zgodnie z wszelkimi obowiązującymi zasadami obrotu tego typu dziełami.
Redakcja miesięcznika „Uważam Rze Historia” nie jest stroną sporu między autorką obrazu a agencją fotograficzną East News.
Jeżeli jednak doszło do naruszenia czyichkolwiek praw w tej sprawie, to bez wątpienia jako przedstawiciele prasy wesprzemy medialnie stronę pokrzywdzoną.

Editor-in-chief's statement
In the April issue of the monthly magazine ,,Uważam Rze Historia” (4/2022) you can see on the cover the photo, which the editors purchased from the East News agency. The author of the photo is not Ms Daria Marchenko, but Terrence Jennings from the Polaris agency.
The photo was downloaded from the website of the East News agency. There are no restrictions, limitations or special pricing conditions attached to the file (as evidenced by the screenshot of the East News website attached below).
Every year, our editorial staff purchases thousends of photos from various photo and press agencies with the full confidence and good faith that these agencies have all rights to trade and sell these works.
The inscription on the cover is not a description of the photo, but the title of the main topic of the monthly issue. The seller of the photo did not require us to put any signature.
I would like to emphasize that the editorial office purchased the photo in accordance with all the rules applicable to this type of transaction on the press market. The claim that a photo was "stolen" is a slander under Art. 212 of the Criminal Code.
It is not in the competence of the editorial office to check the sources of photos put up for sale by photo agencies, including the largest photo bank in Poland, which is the East News agency. Similarly, it is not within our competence to investigate whether the President of the Russian Federation, Vladimir Putin, gave the creators of this picture permission to portray his face.
The editorial office buys photo materials from photo agencies that act as photo commissions.
As an aside, it should be added that the photo of the image of Vladimir Putin's face was put up for sale by the East News agency for a long time. Why did the creators not protest earlier?
I regret that due to the fully legal purchase of this photo by the editors of the monthly magazine ,,Uważam Rze Historia”, the author of the painting feels aggrieved. However, we firmly reject all accusations of an attempt to extort or steal a photo. I repeat once again that the photo by Terrence Jennings from Polaris was purchased in accordance with all applicable rules for the circulation of such works.
The editorial office of the monthly magazine ,,Uważam Rze Historia” is not a party to the dispute between the author of the painting and the East News photo agency.
However, if there has been a violation of anyone's rights in this case, we will undoubtedly, as press representatives, support the aggrieved party in the media.
